What is probate? 

When a person dies in Texas with assets in their name, those assets are often subject to probate, a complex legal process where their will is validated, heirs are determined, assets are inventoried and appraised, debts are paid, and assets are ultimately distributed. And this all happens under a judge’s supervision. The probate process is often dictated by a valid will, but it also applies when a person dies without having signed a valid will. And that is where things can get really overwhelming.
If someone dies without an estate plan designed to avoid probate, the beneficiaries will need to hire an attorney if they want to take control over the estate’s assets. Here are a few other reasons why you need help from a skilled attorney:
Probate ties up finances — All the assets of the estate are frozen until an executor or administrator is appointed, which can take months. Meanwhile, family members may have to pay for expenses relating to the estate or the assets (funeral bills, maintenance of property, taxes, insurance, etc.), until those assets are available. Once the executor is appointed, it could be months or even years before the assets are finally distributed. Probate interferes with family business — If you want to manage or sell a decedent’s business or take action with any other asset (real estate, bank accounts, investment accounts, etc.), you will likely not be able to do so until the probate process has been opened and the executor or administrator has been appointed. Even after that, you still may need approval from a probate judge.
